Wendy Osefo, star of The Real Housewives of Potomac, has filed legal documents requesting the dismissal of multiple fraud charges against her, arguing her October 9 arrest in Maryland was unlawful. Osefo and her husband Eddie Osefo are facing allegations tied to a reported burglary at their home in April 2024, where they claimed luxury items were stolen while vacationing and the investigation raised serious questions about the legitimacy of their claims.

 

In her motion, Osefo’s legal team contends the charges should be tossed due to “defects in the charging document,” claims of unconstitutional search and seizure, alleged illegal wire interceptions and improperly obtained statements or confessions. She also asked that her trial be severed from her husband’s trial and that prosecutors hand over all evidence, witness lists, informant details and any polygraph tests administered.

Prosecutors allege Osefo’s insurance claim listed over $200,000 in stolen goods but investigators pointed out some items were returned to stores before the burglary and social media posts appeared to show Osefo wearing a diamond ring she had reported stolen. She faces 16 counts,  including seven felonies for making false or misleading statements in excess of $300,000 and a misdemeanor for making a false statement to a police officer. Her husband faces 18 charges.

Osefo’s motion argues that the arrest and subsequent handling violated her constitutional rights. She claims the search warrant was invalid, the seizure of evidence illegal and the admission of any statements or wire recordings unlawful. If these claims are accepted by the court, the key evidence against her could be suppressed or the charges dismissed entirely.

Both Osefo and her husband were released on bail after the arrest and have asked for privacy while they focus on their legal case. A spokesperson thanked supporters for their “outpouring of love” and said the couple looks forward to their day in court. For now, Osefo stands firm in claiming she was the victim of an “illegal arrest” and intends to clear her name.
